I'm not a lawyer, but I don't think this falls under the category of freedom of speech. That merely (merely! hah!) provides that you can basically say what you want (within certain limits - you can't yell fire in a movie theatre or slander someone) and the government won't arrest you for it. It doesn't mean news or information is free.
Newspapers can print what they want, but it still costs you money to buy the newspaper. Same with magazines. While you can access network news for free (if you purchased a television), it still costs you the money to purchase cable or satellite to get CNN.
Free speech doesn't mean it doesn't cost money.
I don't see this is much different that cable stations. Some are on the premium packages, some you have to pay extra for.
That said, this is something on general principles that I oppose, and I don't think will get passed anytime soon. Too many moving parts, and the evolution of the net has been such that a lot of the folks behind it wouldn't go for a setup like this, and might very well actively sabotage it. I probably would.
